Tabs don't reach the top of the window when maximized

When moving your mouse to the very top of a tab (or even the minimize/close controls in the top right) it does not select the tab when clicking (when working with a maximized window). Instead, it acts like you're just clicking the window. This is very annoying. Is there any way to fix this?
